BAHAMAS: Dawson-Damer judgment clarifies trustee responsibilities in discretionary trusts

The longest-running trust claim ever brought in the Bahamas has finally reached its conclusion in the UK Privy Council, with the appellant beneficiary Ashley Dawson-Damer again unsuccessful. Dawson-Damer had sought to set aside two appointments in 2006 and 2009 that transferred almost all the USD400 million assets into new trusts from which she was excluded as a beneficiary. She argued unsuccessfully that the trustee had incorrectly identified the corporate settlor's intention as applying the assets for the benefit of future generations rather than herself (Ashley Dawson-Damer v Grampian Trust Company, 2025 UKPC 32).
