JERSEY: Trust law amendment now in force

The Trusts (Jersey) Amendment Law 2026 came into force on 20 March. It will prevent beneficiaries from using the Saunders v Vautier principle to terminate a Jersey trust if there are other persons who could become beneficiaries, or if the trust deed allows distributing trust property for charitable or non-charitable purposes. The law also clarifies the status of a trustee's lien against third-party secured creditors.
