澤西島推遲 2025 年獲得受益所有權的決定

澤西島政府宣布,其從法人實體收集額外受益所有權資訊的提議將不會包含在 2026 年年度確認聲明中。

Jersey postpones decision on access to beneficial ownership for 2025

 
The Jersey government has announced that its proposals to collect extra beneficial ownership information from legal entities will not be included in the 2026 annual confirmation statements.

The proposals, released in May 2025, were intended to support Jersey's plan for 'enhanced beneficial ownership transparency', including legitimate access for some members of the public. The consultation on the proposals invited comments on the extent and nature of beneficial ownership that would be subject to disclosure; information about the levels of ownership collected; timeframes for introduction of these new requirements; and any other matters. It proposed a 1 January 2026 deadline for existing entities to provide the information in their annual confirmations, with new entities founded after that date providing the information on their establishment.
Responses came mostly from trade bodies, trust company businesses or service providers and professionals. Most expressed concern that the 1 January 2026 deadline would not give the industry sufficient time to conform.
Respondents noted that although entities are likely to have this information, collating and reporting it in this way would take time and required considerable changes. This would impact on costs, human resources, policies and procedures, training and IT development, particularly to configure systems and transpose information. One respondent pointed out that the deadline for the EU’s corresponding action was January 2027. Some respondents also queried whether Jersey could make legislative changes in time to meet the proposed timeframe. Concerns were also expressed regarding cost, impact on industry, clients, competitiveness and whether the loss of privacy might impact private wealth business in the island.
'We acknowledge industry concern regarding the logistics and timing of the implementation of these proposals', said the Jersey Financial Services Commission (JFSC) in its response to the consultation results. 'After discussions with government, it has been agreed that implementation of these proposals will not be included in the 2026 annual confirmation statements to give industry more time to make the necessary arrangements.'
However, it stressed that Jersey remains committed to aligning with international standards. It will continue to engage with other registries internationally to try as far as possible achieve alignment of categories and thresholds of beneficial ownership.
'We note that there are ongoing international discussions regarding the balance to be struck between individuals right to privacy and transparency of beneficial ownership', it added. 'We and government aim to continue to engage with the FATF and MONEYVAL, so we are at the forefront of any future developments regarding beneficial ownership. During the intervening period we will work with industry to fine tune the proposals, produce further guidance on categories, thresholds, and reporting. Further work and engagement with industry on the categories and thresholds will take place over the coming months.'
Jersey will now continue to engage with other beneficial ownership registries internationally regarding alignment of categories and thresholds, with the JFSC noting that 'there are ongoing international discussions regarding the balance to be struck between individuals right to privacy and transparency of beneficial ownership'.
